As-Is Basis

The App and services are provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied.

No Automated Filtering of Sensitive Data

You acknowledge and agree that the App does not employ automated filters, classifiers, or screening mechanisms to identify, categorize, or block "Special Categories of Personal Data" (as defined under Art. 9 GDPR) or sensitive personal information. Technically, the App treats all uploaded audio and generated text as standard data packets.

User Responsibility

Voxia is designed as a general-purpose productivity tool. It is not intended for the processing of medical, health, biometric, or other sensitive data. By using the App, you acknowledge that:

• We cannot distinguish between sensitive and non-sensitive data during processing.
• You are solely responsible for ensuring that your User Content does not contain data that you are not authorized to process or that requires specific security standards (e.g., HIPAA compliance).
• Any upload of sensitive data is performed at your own discretion and risk.

Legal Compliance

You agree not to record or upload audio of individuals without their express consent where required by applicable privacy, wiretapping, or surveillance laws.

Ownership

You retain full ownership of all audio files, transcripts, and other content you upload ("User Content").

License for Service Improvement and Machine Learning

By using the Service, you grant us and our third-party AI providers a non-exclusive, worldwide, royalty-free license to use User Content (including audio recordings and transcripts) in a de-identified or pseudonymized form to train, fine-tune, and improve our machine learning models and the services provided by our partners (such as AssemblyAI and Google Gemini). This processing is conducted to enhance transcription accuracy, language support, and overall service performance.

Limited License

You grant us a limited, non-exclusive, non-transferable license to host and process User Content solely for the purpose of providing the services to you.

Binding Arbitration

If you reside in the United States, disputes arising out of or relating to these Terms shall be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA).

Class Action Waiver

You waive any right to participate in a class action or representative proceeding.

Opt-Out

You may opt out of arbitration within 30 days of first use by emailing info@voxia.pro.

Non-U.S. Users

For users residing outside the United States, disputes shall be resolved by the competent courts of the user's place of residence, where mandatory consumer protection laws apply.
